accommodation clause
Article 1 (Scope of Application)

Accommodation contracts and related agreements entered into by this hotel with guests shall be in accordance with the provisions of these general terms and conditions, and any matters not provided for in these general terms and conditions shall be in accordance with laws and regulations or generally established customs.
2
In the event that this hotel agrees to a special agreement that is not contrary to law or custom, such special agreement shall prevail notwithstanding the provisions of the preceding paragraph.
Article 2 (Application for Accommodation Contract)

A person who wishes to apply for a lodging contract with this hotel is requested to provide the following information to this hotel.
- 1 Name of guest
- 2 Date of stay and estimated time of arrival
- 3 Room Rates
- 4Other matters deemed necessary by the hotel

In the event that a guest requests to continue his/her stay beyond the date of stay stipulated in item 2 of the preceding paragraph during his/her stay, this hotel shall treat such request as a new application for a contract of stay at the time such request is made.
Article 3 (Formation of Accommodation Contract, etc.)

The accommodation contract shall be concluded when this hotel has accepted the application as described in the preceding article. However, this shall not apply when this hotel proves that it did not give its consent.

When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, an application fee determined by this hotel within the limit of the basic accommodation charge for the period of stay shall be paid by the date designated by this hotel.

The deposit shall first be applied to the room charge ultimately payable by the guest, and if a situation arises in which the provisions of Articles 6 and 18 apply, the deposit shall be applied in the order of compensation for the penalty, and any remaining balance shall be returned upon payment of the charge in accordance with the provisions of Article 12.

In the event that the reservation deposit as stipulated in paragraph 2 is not paid by the date designated by this hotel pursuant to the provisions of said paragraph, the accommodation contract shall cease to be effective. However, this shall apply only in the event that this hotel has notified the guest to that effect when designating the date for payment of the application fee.

No one other than guests are allowed to enter the room. If a guest’s friend enters the room, it will be regarded as an overnight stay, and the guest will be charged the room rate as stipulated.
Article 4 (Special Provision that Payment of Application Fee is Not Required)

Notwithstanding the provisions of Paragraph 2 of the preceding article, the Hotel may accept a special agreement that does not require the payment of the application fee as specified in Paragraph 2 of the preceding article after the contract is concluded.

In the event that this hotel does not request payment of the application fee as specified in Paragraph 2 of the preceding article or does not specify the date for payment of said application fee when accepting an application for a rooming contract, it shall be deemed to have complied with the special provisions of the preceding paragraph.
Article 5 (Refusal to enter into an Accommodation Contract)

This hotel may refuse to enter into an accommodation contract in the following cases
1 When the application for accommodation is not in accordance with these General Terms and Conditions.
2 When there is no room available due to full occupancy.
3 When it is recognized that the person who intends to stay is likely to act contrary to the provisions of laws and regulations, public order or good morals in connection with the stay.
4 When it is clearly recognized that the person seeking accommodation is a contagious disease patient.
5 When a burden exceeding a reasonable range is requested concerning accommodation.
6 When it is impossible to accommodate guests due to natural disasters, breakdown of facilities, or other unavoidable reasons.
7 When a person who intends to stay at the hotel is likely to cause inconvenience to other guests due to intoxication, etc. When there is language or behavior that is extremely disturbing to other guests.
8 When a person who intends to stay at the hotel is a crime syndicate, a member of a crime syndicate, a group related to crime syndicates (including corporations) or their related persons, or other anti-social forces (hereinafter referred to as “crime syndicates, etc.”).
9 When the person seeking accommodation is a juridical person or other organization in which a crime syndicate, etc. controls business activities or serves as an officer (including key executives), or a person related to such a person.
10 When a person seeking accommodation has made violent, threatening, blackmailing, or intimidating unreasonable demands of the facility or facility staff, or has demanded a burden that exceeds reasonable limits, or when it is recognized that a similar act has been committed in the past.
Article 6 (Guest’s Right to Cancel Contract)

The guest may cancel the accommodation contract by making a request to this hotel.

In the event that the guest cancels all or part of the accommodation contract due to reasons attributable to the guest (except in the event that this hotel specifies the due date for payment of the application fee and requests payment thereof pursuant to Article 3, paragraph 2, and the guest cancels the accommodation contract prior to such payment), this hotel shall charge a penalty fee as listed in Appendix 2. ), a penalty fee shall be charged in accordance with the provisions listed in Appended Table 2. However, in the event that this hotel accepts the special contract stipulated in Article 4, Paragraph 1, it is only when this hotel has notified the guest of the obligation to pay the penalty when the guest cancels the accommodation contract in accepting such special contract.

In the event that a guest does not arrive at the hotel by 8:00 p.m. on the day of the stay (or two hours after the estimated time of arrival, if such time has been specified in advance) without informing the hotel, this hotel may deem the accommodation contract to have been cancelled by the guest and treat the stay as cancelled.
Article 7 (Hotel’s Right to Cancel Contract)

This hotel may cancel the accommodation contract in the following cases
1 When it is recognized that the guest is likely to commit an act contrary to the provisions of the law, public order or good morals in connection with the accommodation, or when it is recognized that the guest has committed such an act.
2 When it is clearly recognized that the guest is a contagious disease patient.
3 When a burden exceeding a reasonable range is requested concerning accommodation.
4 When it is impossible to accommodate guests due to force majeure such as natural disasters.
5 When there is a risk of disturbing other guests due to intoxication, etc., by a person who intends to stay overnight. When there is language or behavior that is extremely disturbing to other guests.
6 When a guest does not comply with the prohibitions of the hotel’s rules of use (limited to those necessary for fire prevention), such as smoking in the bedroom, tampering with firefighting equipment, etc. (limited to what is necessary for fire prevention).
7 When the person who intends to stay is a crime syndicate, a member of a crime syndicate, an organization (including a corporation) related to crime syndicates or their related persons, or any other antisocial force (hereinafter referred to as “crime syndicate, etc.”).
8 When the person who intends to stay is a juridical person or other organization in which a crime syndicate, etc. controls business activities or serves as an officer (including major executives), or its related persons.
9 When a person seeking accommodation makes violent, threatening, blackmailing, or intimidating unreasonable demands of the facility or facility staff, or demands a burden that exceeds reasonable limits, or when it is recognized that a similar act has been committed in the past.

When this hotel cancels the accommodation contract pursuant to the provisions of the preceding paragraph, no charge for accommodation services, etc. that have not yet been provided to the guest will be made.
Article 8 (Accommodation Registration)

Guests are required to register the following items at the time of reservation
1 Name, age, sex, address and occupation of guest
2For foreigners, nationality, passport number, place of entry and date of entry
3Departure date and estimated departure time
4Other matters deemed necessary by the hotel

When a guest intends to make payment of the charges in accordance with Article 12 by a method that can substitute for currency, such as a traveler’s check, hotel voucher, or credit card, the guest is requested to present them at the time of registration in advance as described in the preceding paragraph.
Article 9 (Hours of Use of Guest Rooms)

Guests may use the hotel’s rooms from 16:00 on the day of check-in until 11:00 on the day of check-out.

Notwithstanding the provisions of the preceding paragraph, the hotel may accept the use of a room outside the hours specified in the preceding paragraph. In such cases, the following additional charges shall apply
3,000 yen per room per hour (excluding consumption tax). However, any hours less than one hour will be rounded up to one hour.
Article 10 (Compliance with Usage Regulations)

Guests shall follow the rules of use established by the hotel and placed in each guest room while in the hotel.
Article 11 (Business Hours)

The hours of operation of the hotel’s main facilities are posted throughout the hotel and in the in-room service guide.

The hours in the preceding paragraph may be changed temporarily if necessary or unavoidable. In such cases, notification will be given by appropriate means.
Article 12 (Payment of Fees)

The breakdown of accommodation charges, etc. to be paid by the guest and the method of calculation thereof shall be as shown in Appendix 1.

All payments of accommodation charges, etc. as described in the preceding paragraph shall be made in advance by credit card.

Room charges shall apply even if the guest voluntarily does not stay in the room after the hotel has provided the room to the guest and made it available for his/her use.
Article 13 (Liability of the Hotel)

If this hotel causes damage to a guest in the performance of the accommodation contract and related agreements, or in the non-fulfillment of such agreements, this hotel will compensate for such damage. However, this shall not apply if the damage is not caused by reasons attributable to this hotel.
Article 14 (Handling of Contracted Rooms Not Provided)

In the event that this hotel is unable to provide the guest with the contracted room, this hotel shall, with the consent of the guest, arrange other accommodations under the same conditions as far as possible.
Article 15 (Handling of Deposited Property, etc.)
1 Due to the fact that we do not have a front desk, we are unable to store luggage.
Article 16 (Storage of Guests’ Luggage or Personal Effects)

Due to the fact that the hotel does not have a front desk, we are unable to store luggage before check-in and after check-out. If you mail your baggage to the hotel in advance, it will be automatically returned to you by the shipping company as there is no front desk to receive it.

In the event that a guest’s luggage or personal belongings are left at this hotel after the guest has checked out, and the owner is found, this hotel shall contact the owner and request instructions from him or her. However, if the owner’s instructions are not given, or if the owner cannot be identified, the hotel will keep the baggage for 7 days including the time of discovery, after which it will be destroyed.

In the case of the preceding two paragraphs, the responsibility of this hotel for the custody of the guest’s baggage or personal belongings shall conform to the provisions of paragraph 1 of the preceding article in the case of the first paragraph and to the provisions of paragraph 2 of the same article in the case of the preceding paragraph.
Article 17 (Responsibility for Parking)

The hotel is not responsible for any accidents.
Article 18 (Guest Responsibility)
1
In the event that this hotel suffers damages due to the intentional or negligent act of a guest, said guest shall compensate this hotel for such damages.
